These Terms of Service ("Terms") govern your access to and use of the Pointify POS point-of-sale software, mobile and web applications, and website (together, the "Services") provided by Pointify ("we", "us", or "our"). By creating an account or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Accounts

You are responsible for safeguarding your account credentials and for all activity that occurs under your account, including the activity of any attendants or staff you authorise. Notify us immediately of any unauthorised use of your account.

3. Subscriptions and Payments

Access to certain features requires a paid subscription. Prices, durations, and the number of shops covered are shown at the time of purchase or renewal.
Subscriptions are paid via M-Pesa. You authorise us to initiate the payment request to the phone number you provide and to confirm the transaction you complete.
Subscriptions are valid for the period purchased (for example, 30 days) and do not renew automatically unless stated otherwise.
Except where required by law, payments are non-refundable once a subscription period has begun.

4. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
Attempt to gain unauthorised access to the Services, other accounts, or our systems;
Interfere with or disrupt the integrity or performance of the Services;
Copy, modify, reverse-engineer, or resell the Services without our written permission.

As part of the Services, we send you regular reports and daily summaries of your sales and business activity to the contact details on your account. These reports are provided so that you maintain your own ongoing record of your business data.

You are responsible for keeping copies of these reports and your own records. To the fullest extent permitted by law, Pointify is not responsible or liable for any loss, corruption, or unavailability of data stored in the Services, and we shall not be held liable for any such loss given that you are provided with daily reports that serve as an independent record of your data.

7. Service Availability

We strive to keep the Services available and reliable, but we do not guarantee uninterrupted access. We may suspend or modify the Services for maintenance, updates, or reasons beyond our control.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, Pointify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a way that could cause harm to us or others. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
